Workers Compensation 101

Workers’ compensation in Arizona has a “no fault” system in which injured workers receive medical and indemnity benefits in relation to an industrial illness or injury regardless of cause. Should it be determined to be job-related, the injured worker (the “claimant” or “applicant”) may be entitled to medical treatment, temporary compensation for time loss from work, permanent compensation benefits and vocational rehabilitation.

According to Arizona law, all public and private employers must provide workers’ compensation coverage when employing one or more persons, whether full or part-time.

Right to Compensation

A claimant has the right to seek workers compensation benefits if:

1) The employment caused or contributed to the injury.

2) The employment created a necessary risk or danger inherent to the nature of the employment.

3) The employer, its agent or other employees failed to exercise due care or comply with relevant employment laws.

What to Do in Case of Work-Related Injury

The first thing you should do after suffering an accident on the job (or on the way to/from) is to seek medical attention—even when there aren’t any noticeable signs of injury, since they may develop later. During the consultation, you should notify your healthcare provider that  this was an on-the-job injury and in return you will be provided with a Worker’s and

Physician’s Report of Injury. By signing these forms and submitting to the Industrial Commission of Arizona (ICA), you will legally apply for workers’ compensation benefits

Getting a Second Opinion

As a workers’ compensation claimant, you may get a second opinion and change doctors during the course of examination and treatment. According to Arizona laws, you may do so if:

  • The ICA grants your written request to change doctors.
  • Your current doctor refers you to another doctor or specialist.
  • The insurance company approves your request to change doctors.

About Independent Medical Examinations (IMEs)

Independent Medical Examinations (IMEs) are exams led by a physician upon the request of an insurance company to validate a workers’ compensation or disability claim. The term ‘independent’ is included because the physician is not directly involved with the patient’s treatment, they offer an unbiased diagnosis of the patient to help the insurance company to learn what caused your injury, treatment options, work restrictions, and medically stationary status.
